If you google this question, you will read something like "81% of all NKA incorrect" and "We check your NKA, payment only if successful." I would rather advise against such offers. Formally, this error rate may be correct, so you will almost always find a cent amount. If you think your NKA is incorrect, I would be happy to take a look at it. Most of the time, the error lies in the application of the correct key, but even here you can't say: "This" key is "the right one." The decisive factor is often the rental agreement or the previous year's period.
The landlord is granted a reasonable transitional period by the courts, also because many ancillary costs/bills are often not yet available at the time of moving out. As a rule, a period of 3 to a maximum of 6 months to check possible claims is still considered reasonable. However, there are also landlords who extend this to one year.
With justification by up to 20% in 3 years (15% in regions with rent control) at intervals of 15 months, but if renovation, modernisation and energy-saving measures are added, things can look different again.
What happens if a tenant leaves a joint tenancy? (e.g. shared flat, partnership...)
Everyone has heard it before, "Deadlines in the tenancy agreement for cosmetic repairs are inadmissible"... That's right, the rigid deadlines (the kitchen every 2 years, every 4 years...) have been cancelled. Otherwise, cosmetic repairs must still be carried out, but as required. In other words: when necessary. What these are, in what quality, up to what amount... all this would go beyond the scope of this article. Feel free to write to me and we can arrange a consultation.
